According to employment laws, the government determines each zone's statutory minimum salary in Vietnam.


  • Zone 1 (Urban Hanoi/Ho Chi Minh City): 4,680,000 VND

Working Hours in Vietnam / Viet Nam
General

Working hours in Vietnam are set to 8 hours daily or 48 hours a week. With an Employer of Record in Vietnam, businesses can honor the general working hour schedule.

Overtime

The contract of employment or union contracts control the optional payment of overtime for work surpassing the regular weekly working hours.


Employee overtime hours have a limit 200 hours per year under Article 107.2(c) of the Labour Law 2019 olus Article 61 of Decree 145/2020; with few exceptions where employees may work up to 300 hours per year. Only a few production industries or other situations permitted by the government qualify as exceptional cases.


However, Resolution 17/2022 removes this limitation by enabling the employer and employees to come to an agreement to increase the number of yearly extra hours to no more than 300 hours irrespective of the industry or conditions, with the exception of the following employees:


  • 15 to 18 year old workers.
  • Having employees with mild disabilities who have a minimum 51% reduction in job capacity or employees with severe disabilities.
  • Take on exceptionally heavy, risky, dangerous, or hazardously hard job.
  • Pregnant female employees who are in their seventh or later month of their pregnancy, or in their sixth month if they work in a mountain, deep-lying, rural, border, or island location.
  • Working mothers with young children under 12 months.


Under Resolution 17/2022, the employer must inform the labor authority whenever it arranges for staff to work overtime.


Additionally, under Resolution 17/2022, employers can make arrangements for their staff to work no more than 300 hours per year; subject to demand and with the approval of the staff. As well as up to 60 hours of overtime each month. Under the 2019 Labour Code, this maximum is 40 hours exclusively.

Working Week

Employee Termination in Vietnam / Viet Nam
Termination Process

Unless an employer can demonstrate sufficient justification for termination without notice, Vietnam's conventional termination procedure goes according to the standards of the Labour Law (due to misbehavior, etc.)


Written termination notice must be sent to the appropriate governmental authorities.


All workers have the following rights upon the end of the employment agreement:


  • The remaining pay for the working days during that month.
  • A severance payment when they quit their job due to the termination of their employment contract due to structural, technological, or economic changes; separation, division, convergence, or merger; lease, sale, or type conversion; transfer of ownership, or the right to use property; and have been working with the employer on a regular basis for at least one year.
  • Any unused time off (pro-rata) is allowed.


Additionally, the employer must pay the remaining wage within 14 working days of the date the labor contract was over (Article 48 of the Labour Code 2019). Although this time frame may see an extention, it cannot go above 30 days.


If an employee demands copies of papers important to the performance of their job, the employer must pay the costs of duplicating and shipping those documents, as well as the fees associated with sending notices of termination to the appropriate government agencies.

Notice Period

Notice periods in Vietnam are typically around 30 and 45 days, but vary depending on the type of agreement:


  • A seasonal contract is for three working days.
  • 30 days for a permanent labor agreement (between 1-3 years).
  • 45 days for a labor contract that is indefinite.

Severance Pay

Severance compensation is mandatory in Vietnam if applicable and is decided by the employee's contract conditions and duration of service.


For each year of service, statutory severance compensation is at 50.00% of the employee's regular monthly salary rate. Assume, however, that the compensation payment is being made because of shifts in the company's technology, structure, or economic factors. In that situation, the severance pay is one month's salary for every year of service.


Furthermore, if a person leaves their job before becoming eligible for a pension, they can obtain a severance payment. With an Employer of Record in Vietnam, companies can deal with these payments and more.

Probation Period

The probationary term in Vietnam for permanent employees typically ranges from 6 to 60 days and is depending on the intricacy and level of competence needed to perform the function. It must be agreed in writing that the employee's pay during the probationary term will not be under 85.00% of the full-time pay for the position.


Employees covered by seasonal labor agreements are exempt from probation.

In Vietnam, paid leave is stated in the contractual relationship as a minimum of twelve days per year, plus any public holidays. For every 5 years of service that have been completed, this rises by one day.

Sick Days

Every employee is entitled to a maximum of 30 paid sick days annually, with the potential for an additional 60 days under special circumstances. The Social Insurance Authority covers sick time.


According on the salary earned in the month before to the absence due to illness, the social security fund calculates the sick pay at a rate of 75.00% of the monthly wage.


Within 48 hours of the initial day of illness, all employees are required to submit a medical certification.

Paternity Leave

For five to fourteen days, new fathers are eligible for compensated paternity leave.


The Social Insurance Authority pays the leave at a rate equal to 100.00% of the wage the worker earns in the month before the paternity leave begins.

Paternal Leave

Parental leave is offered in Vietnam for childcare, and employees are eligible for up to 20 days of leave annually until the child turns three, and then up to 15 days annually until the child turns seven. The Social Insurance Authority pays for childcare leave at a rate equal to 75.00% of the employee's earnings in the month before the leave begins.

Other Leave

Employees may be permitted extra leave kinds, with approval between the workers and employers, for the following reasons, depending on the contract:


  • Workers are eligible to three days of leave pay following a family member's death.
  • Employees may take up to three days off work for a wedding and 1 day for a child's wedding.

Maternity Leave in Vietnam / Viet Nam

An employee who is pregnant is eligible for six months of maternal leave, which could be extended to 7 months in cases of problematic births or multiple births.


The Social Insurance Authority provides maternity benefits at a rate equal to 100.00% of the wage earned in the month before the start of the leave of absence.


According to the new Labour Code, a female employee has a right to a fully paid break of 30 minutes per day during her period (for at least 3 working days each month). If she has a child under 12 months she has a right to a full pay break of 60 minutes per day during her work time while she is nursing.


Decree 145 stipulates that a female employee who declines to take these rests and the employer permits her to carry on working must obtain an additional compensation in accordance with the work that she finishes during the break.
