General

An employer of record in Saint Lucia may not ask any employee in Saint Lucia to work more than forty hours per week, excluding overtime. A typical work week is 40 hours long, with eight hours of labor every day. No employee may work more than six consecutive days in a row in order to have enough rest each day.


Employers may explain several clauses in the employment law agreement, but not on all other days. If a Sunday worker is obligated to offer service, they must be paid 200% of their regular rate.

Overtime

Overtime refers to labor done after the agreed-upon periods in Article 6 (excluding shift employees) and is paid as follows:


  • From Monday through Friday


During the first three (3) hours, at a time and a half; double time afterwards.


  • Saturdays


During the first four (4) hours, it is time and a half; after that, it is double time.


  • Sundays and Public Holidays


For the first eight (8) hours, at double time and half; then at triple time.

Employee Termination in Saint Lucia
Termination Process

An EOR has the right to fire an employee who has committed substantial misbehavior of such a sort that it would be unreasonable to force the employer to continue the employment relationship.


  • Serious misconduct includes, willful disobedience of lawful orders issued by the employer; repeated substantial neglect of duties; repeated absences from work without the permission of the employer or without reasonable excuse; refusing to follow health and safety measures instituted at work, thereby endangering the health and safety of employees or members of the public.
  • Theft or willful damage to the employer's or another employee's property at work; or behavior inconsistent with the fulfillment of the written or implied requirements of the employee's employment contract.


Except during the probationary period, an employer may terminate a contract without regard to time limits by providing the employee with the following minimum durations of written notice.


If the period of continuous employment exceeds twelve weeks but is less than two years, one week's notice is required; two weeks' notice is required if the period of continuous employment is two years or more but less than five years; four weeks' notice is required if the period of continuous employment is five years or more but less than ten years; and six weeks' notice is required if the period of continuous employment is more than ten years.


When an employee's employment is terminated due to redundancy, he or she is entitled to redundancy pay equivalent to one week's basic pay for each completed year of service up to the initial three years; two weeks of basic payments for each complete year of service in additional of three years and up to seven; or three weeks' basic pay for each one of the complete year of service in extra of seven years.

Notice Period

Except during the probationary period, an employer may terminate a contract without reference to time limits by giving the employee the following minimum periods of notice in writing: one week's notice if the period of continuous employment is more than twelve weeks but less than two years; two weeks' notice if the period of continuous employment is two years or more but less than five years; four weeks' notice if the period of continuous employment is five years or more but less than ten years.


The Employee must provide the Employer with written notice (Section 153).


If the person has worked consistently for more than 12 weeks but less than 5 years, the time limit is one week.


Not less than 2 weeks if the person has worked consistently for more than 5 years.

Severance Pay

When an employee's employment is terminated due to redundancy, he or she is entitled to redundancy pay equivalent to one week's basic pay for each completed year of service up to the initial three years; fourteen days of basic pay for each complete year of service in additional of three years and up to seven.

Probation Period

A new employee may have to serve a probationary term of up to twelve weeks, or for a shorter or longer amount of time if the employer and the employee agree.

Vacation leave shall be calculated in working days: Mondays to Fridays excluding Holidays. Time off to attend to urgent private matters should be taken from accumulated vacation leave.
