Working Hours in Portugal
General

In Portugal, the standard working hours are 40 hours a week, which means 8 hours per day. And the maximum weekly and daily working hours differ as collective bargaining agreements or employment contracts of Portuguese workers stipulate.


The Portuguese authorities implemented considerable changes in 2022 in the remote working regime. For example, one of the most significant changes is that employers must have a written agreement to enact remote work. And, in case there are 10 or more workers, the employer will permit workers with children up to 8 years old to work under a remote work regime.


Moreover, there is also a new rule on contact outside of working hours. According to this rule, employers must refrain from contacting their employees during their rest period. However, there can be an exception in the case of force majeure.

Overtime

Employment contracts or collective agreements regulate overtime, which is the payment for all work that exceeds the standard 40 weekly hours. And generally, overtime maximum limits are set on a weekly basis as 2 hours a day. Therefore, there is a maximum of 48 working hours per week and 150 hours per annum. But this schedule is for Portuguese employees working in a company with more than 50 employees.


So, for companies with less than 50 employees, there would be 175 hours per annum. Furthermore, collective bargaining agreements or employment contracts will stipulate the maximum daily, weekly, and annual overtime hours.

Notice Period

Generally, employment contracts or collective agreements stipulate notice periods in Portugal. Besides, notice periods are linked to the employee’s length of employment, as follows:


  • If the employee served for less than 6 months, they receive a 7-day notice.
  • For serving between 6 and 48 months, employees receive a 1-month notice.
  • For serving more than 2 years, employees receive a 2-month notice.

Severance Pay

In Portugal, severance pay depends on many factors, which include the terms of the employment contract. Additionally, the role/position of the employee and the reason for termination are other factors that influence the severance pay calculation.

Probation Period

In Portugal, the probation period for a permanent employee consists of 90 days for most roles. However, for highly technical or complex roles, it is a 180-day probation period. And for management, directorate, and similar responsibility roles, the probation period lasts 240 days.

Paid Time Offs

The employment contract of an employee sets paid leave as a minimum of 22 days of paid holiday per year. But the employees can receive this entitlement in addition to public holidays following the completion of 1 year of service.


Employees must apply for all paid time off requests before the start of their leave and obtain approval from their employer. And the leave can be carried forward into the next year, but employees must use it by April 30th.


On the other hand, employees can obtain 20 days of leave during their first year of employment. And they will accumulate them as 2 days every month. Nonetheless, if the employment starts during the first half of the year, employees will receive 8 days of vacation after completing 60 days of work. And, if the calendar year ends before employees complete 6 months, these days will be extended until June 30th the following year.

There are 22 vacation holidays throughout the year.

Sick Days

Before receiving a sickness benefit, employees must obtain a valid certification from a competent health service doctor. And this certification must state that they are unable to work. Furthermore, they must have completed employment service of at least 6 calendar months, consecutive or otherwise.


On the other hand, sick leave calculation involves a daily benefit and applies a percentage to the employee’s reference remuneration. And this percentage can vary depending on the duration and nature of the employee’s illness, as follows:


  • In case the illness lasts for up to 30 days, the employee will receive 55% of the reference remuneration.
  • In case the illness lasts between 31 and 90 days, the employee will receive 60% of the reference remuneration.
  • But in case the illness lasts between 91 and 365 days, the employee will receive 70% of the reference remuneration.
  • Lastly, if the illness lasts more than 365 days, the employee will receive 75% of the reference remuneration.


In addition, the sick leave period depends on the duration of the illness. And it is also subject to the following maximum periods:


  • For employed workers, seafarers, and coastguards, it is up to 1,095 days.
  • For self-employed and scientific research grant holders, it is up to 365 days.

Paternity Leave

There is a compulsory leave for fathers in Portugal, which has increased from 15 to 20 days. Furthermore, there is an optional paternity leave as well, but it has decreased from 20 to 5 days. On the other hand, fathers must take paternity leave within 6 weeks of their child’s birth. And they must also use no less than 5 days’ leave immediately after childbirth. Plus, they can take paternity leave as a single period or in a series of days.


Social security pays this leave at 100.00% of the workers’ average salary in the last 6 months.

Paternal Leave

Once the required 6 weeks of maternity leave and 20 days of paternity leave have passed, the couple can choose who takes the following 78 or 108 days. And if they choose to take a total of 150 days, they will receive a paid parental leave of 80.00%. However, if they take 120 days, they will receive 100.00% of paid leave.

Other Leave

In the case of a family bereavement, employees in Portugal can take up to 5 consecutive days of paid leave.


They can also receive 30 days of paid leave annually to provide urgent and essential care for a family member. But in this case, the family member has to be younger than 12 years old. And for an older family member, employees will receive 15 days of paid leave.


In addition, employees can receive 15 consecutive days of paid leave in case they are getting married.

Maternity Leave in Portugal

Expectant mothers who are eligible can receive 100.00% of their usual salary rate for 120 days, which Social Security will pay. And in order to be eligible, employees must have been employed for at least 80 days of the previous 12 months before the expected due date.


Furthermore, under Portuguese law, employees can receive parental leave for the birth of their child. And both parents can share this leave. In that case, the total parental leave period would be 180 days (paid at 83.00% of the usual salary rate). And the mother receives 30 days of parental leave before delivery, along with a minimum of 6 weeks after childbirth.
