Termination Process
Termination Process
The company may terminate part or all work contracts when necessary owing to force majeure, economic, or technological situations, according to the restrictions in the Labor Law.
In addition, under some circumstances, such as the following, a company may unilaterally cancel a contract of employment without prior warning or severance pay:
- The worker makes up their nationality.
- The employee's performance throughout the three-month probationary period has not satisfied the company.
- If the employer did not notify the Ministry of Labor in advance of the infringement within three days after its verification, the employee is judged to have engaged in a deliberately negligent act or omission intended to harm the financial interests of the employer.
- Three severe violations of the company's internal rules are made by the employee in a given year, notwithstanding written warnings.
- The employee misses over 15 days of work or more than 7 days in a row in a calendar year without a justifiable reason.
- The worker was convicted of a felony or committed a misdemeanor while performing work-related duties and was given a minimum one-year prison sentence.
- The employee hits the management or the employer during work.
Otherwise, prior written termination notice must be served. Consequently, the employee may need clarification on the reasons for the termination. Also, an employment contract shall not be canceled in an unjust or abusive manner.
Notice Period
The period of notice that the law requires cannot be lowered. It changes according to the employee's length of service:
- Under 3 years: one month's notice is necessary.
- 3 to 6 years: two months' notice is necessary.
- Between 6 and 12 years: three months' notice is necessary.
- Over 12 years: four months' notice is necessary.

- 6 to 10 years of service: 100% of the pay for 2 months plus 50% of the income for another 2 months.
- Above 10 years of service: 100% of the income payable for 2 and a half months, followed by 50% of the wage payable for the remaining 2 and a half months.
