In Greece, the payroll cycle is generally monthly. And employers must process payments on the same day of the month. As per the employment law in Greece, employees working in the private sector can receive two additional monthly salaries. But they will receive these salaries in 3 payments. Firstly, there is 1 full monthly salary for Christmas. Secondly, they will also receive half a monthly salary for Easter. Thirdly, they can receive half a monthly salary as a Vacation Bonus. And employers must pay all these payments only in cash (not in kind).

Particularly, the payment of the Christmas Bonus must be made by December 21st. And, in case the employer does not pay it on time, the employees can apply to the relevant Labor Inspectorate. The entity known as the Labor Inspectorate of SEPE is in charge of imposing the corresponding fines.

Also, their work permits will be valid for only 1 year. But they can renew it at least 60 days before the expiration date.

On the other hand, business visitors to Greece usually need a local version of the Schengen C Visa (unless they are visa-exempt). Note that the Schengen Area limits stay to 90 days in 180 days. And business visits are usually limited to a few days. In other words, the pertinent Greek authorities, on a case-by-case basis, will determine the exact duration of stay.

Employee Termination in Greece
Termination Process

In Greece, the termination process can vary as per the collective agreement or employment agreement in place. Besides, the type of contract and the reason for termination are also key factors for the process. Furthermore, in order to terminate Greek employees on indefinite contracts, employers must provide written notice of termination. Plus, employees must have been registered with the EFKA (Unified Social Security Fund). With an Employer of Record in Greece, you can discover further information about the termination process.

Notice Period

Employment contracts or collective agreements may contain provisions on notice periods. But in some cases, collective agreements may stipulate notice periods that differ from the statutory periods. And, in that case, the employer and employee must observe the notice periods laid down in the agreement or contract.

On the other hand, the length of notice periods will mostly depend on the length of service of the employee. Plus, the reason for termination will be also a relevant element. But in case the employer terminates the contract, the notice period will be as follows:

  • The employee served between 1 and 2 years:1 month notice period
  • The employee served between 2 and 5 years: 2 months notice period
  • The employee served between 5 and 10 years: 3 months notice period
  • The employee served for more than 10 years: 4 months notice period

Severance Pay

Using the length of the employee’s service as a reference, the employer must calculate the amount of severance pay. And usually, this amount can range between 1 and 6 months of wages. Furthermore, if the employer does not provide the necessary notice, the amount of the severance payment shall be doubled. With an Employer of Record in Greece, calculating severance pay can be easier.

Probation Period

For indefinite employment contracts in Greece, the first year of employment is the probation period. An Employer of Record can help you obtain more information about probation periods in Greece.

Employee Leaves in Greece
Paid Time Offs

An employee can receive two days of holiday for each month of employment during their first year of service. Therefore, it would be 20 days for the year for a 5-day working week, and 24 for a 6-day week. After completing one year of service, the employee’s holiday entitlement increases by one day for the second/third years of service. As a result, it would be 22 days for a 5-day working week and 26 days for a 6-day week.

Furthermore, the holiday entitlement will remain the same for each year until the worker has completed 10 years of employment. And that is when the number of days will increase to 25 and 30 days, respectively. Moreover, it will increase by one day once the employee has completed 25 years of service. Therefore, it would be 26 days for a 5-day working week and 31 days for a 6-day week. To learn more about paid time off, try requesting the services of an Employer of Record in Greece.

Paternity Leave

Among the statutory benefits that employees in Greece can receive, there are two days of paid paternity leave.

Paternal Leave

Any parent who has completed 1 year of service can receive parental leave until their child reaches 8 years old. And this leave equals 4 months, which the employee can take continuously or intermittently, as agreed with their employer.

On the other hand, childcare leave is also available for 30 months after childbirth or adoption. And this leave entitles an employee to a reduction in the daily working hours by 1 hour, which is paid. Or it can be 18 months of a reduction of 2 hours in the daily working hours (during the first 12 months). Therefore, it reduces to 1 less working hour in the remaining 6 months. Or it may also be 3.5 months of paid leave taken in one period.

Other Leave

According to the employment contract or collective agreement terms, employees may take other types of leave. And between the employer and the employee, they can approve the following:

  • Bereavement Leave: in the event of the death of a member of their immediate family, an employee can take up to 2 days of paid leave.
  • Marriage Leave: if employees are getting married, they can take up to 5 days of paid leave.
  • School Leave: this leave type is for employees with children of up to 18 years of age who attend school. And both parents, whether they are full-time or part-time employees, can be absent from work for some hours or a full day. However, they can only be absent for up to 4 working days a year. Besides, upon their employers’ permission, there will be no deductions from their salaries.
  • Caretaker Leave: if an employee has completed 6 months of employment, the employer can provide them with 5 days of paid leave. And this particular type of leave is for taking care of a relative or any other person living with the employee.
  • Leave in case of sickness of a dependent family member: if a child or other dependent family member is sick, employees can take up to 6 days per annum of unpaid leave. And they can take these days of unpaid leave continuously or intermittently. However, if an employee has two children, their days of unpaid leave increase to 8. Furthermore, if an employee has three or more children, their days of unpaid leave increase to 14.

Female employees who are pregnant are eligible for the maternity leave entitlement, which consists of 119 calendar days. The condition for receiving this paid benefit is that employees do not work during the 56 days before the due date. And they should not work during the remaining 63 days after childbirth either.

On the other hand, the employer must pay the maternity benefit at 100% of the employee’s regular salary rate during the first month. And from the second month onwards, they will pay the benefit at 50% of the regular salary rate with the e-EFKA. And this payment corresponds to the insurance contribution class of the insured person. In addition, there is a payment of child benefits for each child.

Furthermore, there is a Supplementary maternity allowance payable from the second month. And its amount equals to the difference (if any) between the paid salary rate and the maternity benefit.

However, employees who are not insured will receive a standard maternity benefit, which is equal to EUR 220.10. An Employer of Record in Greece can help you calculate the exact amount of maternity leave payment for your employees.
