Severance Pay

But employers must calculate it as a multiple of the remuneration payable to the employee before termination, as follows:


  • The employee who served for less than 5 years, gets 2 times the regular salary payment
  • The employee who served between 5 and 10 years, gets 3 times the regular salary payment
  • The employee that served between 10 and 15 years, gets 4 times the regular salary payment
  • The employee that served between 15 and 20 years, gets 5 times the regular salary payment

Furthermore, workers forfeit their claim to receive the severance payment from their employer. But this can only happen if they resign without cause or if they are summarily dismissed for a reason. On the other hand, there is a new severance pay scheme that applies to those whose employment began after December 31, 2002. And the new severance pay scheme is due to the regulated requirement for employers to pay monthly contributions. According to the law, these contributions equal 1.53% of the pre-tax salary to an outside severance fund provider.

Sick Days

In Austria, sick leave entitlement will vary according to the employee’s length of employment as follows:


  • The employee who served for 1 year, gets 6 weeks of paid sick leave
  • The employee who served between 2 and 15 years, gets 8 weeks of paid sick leave
  • The employee that served between 15 and 25 years, gets 10 weeks of paid sick leave
  • The employee who served for more than 25 years, gets 12 weeks of paid sick leave


However, Social Security will cover any sick leave beyond the above entitlement. In addition, employees must provide a valid certificate to receive their corresponding sick leave entitlement.

Paternity Leave

In Austria, employees who are fathers can receive an entitlement to 1 month of unpaid paternity leave. And they can start taking these days of leave any time after their child’s birth and up until their child turns 2 years old. Furthermore, note that this month of leave is often referred to as “Daddy Month” in this country. However, before receiving this leave entitlement, the employee must notify their employer 3 months before the estimated childbirth date.

Paternal Leave

After maternity leave finishes, parental leave starts. And in this case, parents can take it until their child reaches 24 months of age. Plus, parents will also receive a payment under the Child Care Payment Act from Social Security during their parental leave.

Other Leave

Maternity Leave in Austria

Female employees who are expectant mothers can receive a maternity leave entitlement that consists of 16 weeks. And they cannot work for 8 weeks before the expected childbirth date and for the following 8 weeks either. However, in the case of a Caesarean section or high-risk delivery, employees will not work for 12 weeks after childbirth. Maternity leave is an entitlement that employees receive as a weekly allowance that the Social Security provider pays.


And the calculation of this allowance will depend on the average earnings of the last 3 months before the Maternity Leave began. Then, after 16 weeks, the employee will receive unpaid maternity leave until the child reaches 2 years of age.
